Terms of use
This legal agreement (the “Agreement”) is established between you, the user (referred to as “User” or “You”), and MeriSkill (referred to as “we,” “us,” or “MeriSkill”). This Agreement outlines the terms governing your use of our website, www.MeriSkill.com (collectively referred to as the “Platform”), and the curated, industry-relevant online Job Simulations or Programmes provided by MeriSkill, which may be offered individually or as bundled packages (the “Tracks”).
By accessing the Platform and utilizing the Tracks, you agree to comply with and be bound by this Agreement, as well as our Terms of Use, Privacy Policy, and other policies available on the Platform (collectively, the “Terms”). If you do not agree to these Terms, you are not authorized to use the Tracks, and any subsequent use will be considered unauthorized.
Each Track may have specific terms regarding refunds, deferrals, payments, and other related matters. Corporate clients may have separate written agreements with us, which will take precedence over these Terms in the event of a conflict.
These Terms also extend to MeriSkill-hosted mobile apps, social media groups (e.g., WhatsApp, Facebook, Instagram, Telegram or any social media handle), email/SMS/phone communications, and other forums, collectively included as part of the “Platform.” You acknowledge that some portions of the Platform are provided by third-party service providers, and you agree to adhere to their terms and conditions. MeriSkill is not liable for service disruptions caused by these third-party providers.
Even if you bypass these Terms by bookmarking a particular section of the Platform, your use of the Platform still subjects you to these Terms.
We may modify these Terms periodically without prior notice. It is your responsibility to review this page regularly. Continued use of the Platform and Tracks after any changes signifies your acceptance of the revised Terms. If you disagree with any changes, you should discontinue use of the Platform and Tracks.
MeriSkill does not guarantee that the Platform is operational or legally permitted in all geographical locations. The availability of information, services, or products offered through the Platform may not be appropriate or accessible in all regions. Accessing the Platform from areas where it is illegal is expressly prohibited. If you choose to access the Platform from such locations, you do so at your own risk and are solely responsible for complying with all applicable laws.
User Conduct Policy
Once you access the Platform or Tracks, you are considered a ‘user’ under these Terms. You are responsible for your activities on the Platform and Tracks and agree to comply with all applicable laws and regulations. You must avoid any unethical practices while using the Platform.
You must not post or send any communication or solicitation designed to obtain passwords, account details, personal information, or any other confidential information from other users or third parties. If such an event occurs, MeriSkill is not responsible for any data loss or compromise of your device, computer, or other property.
MeriSkill reserves the right to report any suspicious or illegal activity to the appropriate authorities without notifying you.
While using the Platform and Tracks, you must:
– Not harass other users, students, attendees, support agents, or visitors;
– Not create a hostile or disharmonious environment within student groups;
– Not cheat on homework assignments or exams for any Track;
– Not post secure testing materials online;
– Not share solutions to homework assignments or exams; and
– Notify instructors immediately if you become aware of any cheating or breach of these Terms and comply with any specific code of conduct related to the Track you are enrolled in.
User Accounts, User Registration and Delivery of Services
To participate in most activities on the Platform and apply for Tracks, you must register for a personal account (“User Account”). This involves a two-step verification process to confirm your login details, such as receiving a one-time password on your phone number or using an email address and unique password.
Once you pay the Track fees, whether in full or part, MeriSkill will deliver the Track’s terms of use and grant you access. An invoice will be provided along with email confirmation or within two months thereafter as proof of payment.
In exceptional cases, if MeriSkill grants you access pending payment and doesn’t receive payment within the specified time, MeriSkill may withdraw your access at its discretion without prior notice.
You agree not to share your User Account access with anyone else and to create and use only one User Account. You must provide accurate, current, and complete information during registration and keep it updated. Providing false, inaccurate, outdated, or incomplete information may result in termination of your Platform use or Track enrolments.
During registration and use of the Platform or Tracks, we may collect certain information about you, including Personally Identifiable Information, which may be shared with Educational Partners or third parties for services or marketing purposes, as detailed in our Privacy Policy. By submitting our web form, you consent to receive promotional calls and messages from us or third parties.
Access to Tracks is limited to registered attendees or students authorized by MeriSkill.
By registering, you agree:
– To register for a Track only once and not create multiple User Accounts.
– To comply with these Terms and any specific Track terms.
– That MeriSkill may contact you via WhatsApp.
Additional obligations apply to Students, who agree to complete relevant assignments for enrolled Tracks.
Payment Terms and Refund Policy
To participate in a Track, full payment is required at the time of registration unless otherwise agreed upon in writing by MeriSkill. If a Track includes a trial period, this period starts only after full payment. Within the trial period, upon a student’s request and satisfaction of MeriSkill, a refund of Track Fees may be issued, subject to deductions decided by MeriSkill. Once the trial period ends, no refunds will be permitted for any reason, unless explicitly stated otherwise on the website, typically for a 7-day trial from enrolment.
It’s your responsibility to verify the accuracy and suitability of the selected Track. Enrolment in a Track cannot be transferred to another individual.
To make payments or purchase services/products through the Platform, you need internet access and a current valid payment method. MeriSkill does not store credit card or sensitive payment information; it partners with payment gateways compliant with Reserve Bank of India regulations. By using third-party payment providers, you agree to their terms. Any loss resulting from storing such information by these providers is your responsibility, and MeriSkill is not liable.
Failure to pay Track fees may result in access withdrawal. Depending on your location and payment method, foreign exchange fees or rates may apply. MeriSkill may not support all payment methods, currencies, or locations. Taxes are calculated based on your billing information provided at enrolment/purchase.
Use of Tracks
MeriSkill reserves the right to cancel, reschedule, or adjust any Track, including live lectures/webinars, topics, assignments, tests, and evaluations, at its discretion. MeriSkill may also limit, suspend, or terminate your access to the Platform, Tracks, and related services such as coaching, support, evaluations, or certifications. Additionally, MeriSkill may modify or discontinue any service related to its Tracks without liability to you or any third party. These Terms do not require MeriSkill to maintain or support the Platform, Tracks, or associated services indefinitely.
MeriSkill is not liable for any non-availability of the Platform due to events beyond its control, such as natural disasters, wars, epidemics, strikes, or technological failures.
If you wish to discontinue using a Track, you can terminate your participation by notifying MeriSkill in advance. Access to online Job Simulations, lectures and webinars is provided via email, and you agree not to share this access with others. If you cannot attend a live session, please inform MeriSkill beforehand.
You are responsible for obtaining and maintaining the necessary equipment and services to access the Platform, including hardware, software, and internet or mobile connections. You are also responsible for associated charges. Ensure your equipment and services are compatible with the Platform.
Educational Partners and Accreditation
MeriSkill operates as an education service provider in collaboration with various Indian and International universities, educational institutions, governmental bodies, NGOs, and corporates (collectively referred to as “Educational Partners”). It’s important to note that MeriSkill is not a university itself.
Enrolling in and completing a Track with MeriSkill does not automatically enroll you in any Educational Partner’s program or grant you access to their resources or privileges beyond the specific Track you are enrolled in.
MeriSkill may issue credentials or acknowledgements for participants who demonstrate mastery of Track material, but the decision to award these credentials is solely at MeriSkill’s discretion. Not all Tracks may offer such credentials.
Any Track Certificate you receive from MeriSkill is based on MeriSkill’ s criteria and, if applicable, the requirements of its Educational Partners. However, these certificates are not affiliated with any Educational Partner and do not provide academic credit or certification recognized by them.
If you are seeking academic credit or certification from an Educational Partner for a Track, you must adhere to the Educational Partner’s own policies and procedures. MeriSkill does not award academic credits or certifications from Educational Partners.
Participants in Tracks associated with Educational Partners may be subject to additional terms and policies set by those institutions. If you are a student registered with an Educational Partner and taking a Track for credit or certification through them, the Educational Partner’s policies regarding eligibility, participation, and academic records will apply, and MeriSkill does not oversee these aspects.
It’s essential to understand that MeriSkill’s role is to provide educational Tracks and associated certificates, distinct from the academic programs and credentials offered by its Educational Partners.
MeriSkill’s Intellectual Property Rights
The Platform, Tracks, and related services are owned and operated by MeriSkill and its licensors. All content and materials available on the Platform or through Tracks, such as lectures, videos, quizzes, assignments, and software, are the property of MeriSkill or its affiliates and are protected by copyright and other intellectual property laws in India and internationally.
MeriSkill logos, trademarks, and service marks (collectively “MeriSkill Marks”) appearing on the Platform or Tracks are owned by MeriSkill and are protected under Indian and international laws. Any other trademarks, service marks, or logos used on the Platform belong to their respective owners.
You agree not to reproduce, copy, sell, exploit commercially, or misuse any MeriSkill content or Marks without explicit written permission from MeriSkill. This includes refraining from using Educational Partner names, trademarks, or materials for unauthorized purposes or unsolicited communications.
If you encounter any incorrect, infringing, offensive, or objectionable content, please notify us promptly.
Occasionally, MeriSkill or its third-party providers may ask users to review content or beta-test the Platform. Any resulting works from such activities belong exclusively to MeriSkill or its providers.

Third-Party Intellectual Property
MeriSkill values and respects third-party intellectual property rights, including copyrights and trademarks (“IP”). We promptly address clear notices of alleged IP infringement by removing or disabling access to the material claimed to be infringing.
MeriSkill cannot be held responsible for unauthorized use of any third-party IP on the Platform. Users who engage in such unauthorized use or infringement of IP on the Platform are solely liable and agree to indemnify MeriSkill against any resulting claims.
If you believe your product or work has been misrepresented or used in a way that infringes your intellectual property rights, please provide us with the following:
– A statement from the authorized person acting on behalf of the IP owner.
– Description of the IP that has been misrepresented or infringed.
– Details of where the infringing material is located on the Platform/Track.
– Your contact information: address, phone number, and email.
– A statement affirming that the use of the disputed material is not authorized by the IP owner or law.
– A statement under penalty of perjury that the information provided is accurate and that you are the IP owner or authorized to act on their behalf.

Limited License
The services provided on the Platform are licensed to you, not sold. By agreeing to these Terms, MeriSkill grants you a personal, non-transferable, revocable license to access and use the Platform and Tracks, solely in accordance with these Terms. This means you can use the Platform and access Tracks for your personal, non-commercial use.
You are permitted to download or copy portions of the MeriSkill Content from the Platform for your personal use, as long as you maintain all copyright and other notices included in the content. However, you may not sell, resell, reproduce, publish, modify, transfer, distribute, commercially exploit, or create derivative works from the Platform, Tracks, or any MeriSkill Content.
Certain reference documents, digital textbooks, and articles may be available with permission from third parties, and your use of these materials is subject to specific rules and conditions, which you agree to follow.
You are not allowed to reverse-engineer, decompile, disassemble, or access the source code of any software used on the Platform or Tracks. Any software or code provided by MeriSkill for instructional purposes is strictly for non-commercial use; commercial use is prohibited.
MeriSkill, its affiliates, and licensors retain all rights not expressly granted in these Terms to the Platform, MeriSkill Content, and MeriSkill Marks.
Here are examples of uses explicitly prohibited by MeriSkill:
– Selling or renting any part of the MeriSkill Content or derivative works.
– Selling access or links to any part of the MeriSkill Content.
– Providing training or services using MeriSkill Content for a fee.
– Using MeriSkill Content in educational institutions where tuition is charged.
– Using MeriSkill Content for internal professional development or training in for-profit or non-profit organizations.
– Displaying or uploading MeriSkill Content in publicly accessible places, including social media, video download sites, and torrents.

User Content
On the Platform, you may be able to post forum messages, chat with others, interact with MeriSkill’s counselors, participate in discussions, create profile pages, and share other content and media for social interaction. Additionally, you may submit information and materials related to the Tracks, such as questions, examples, assignments, and industry projects (collectively “User Content”). MeriSkill does not claim ownership of any User Content you provide or make available on the Platform or Tracks. Therefore, you retain full ownership of your User Content, subject to the license granted to MeriSkill below.
By submitting User Content through the Platform or Tracks, you grant MeriSkill an irrevocable, worldwide, perpetual, royalty-free, and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display your User Content on the Platform or Tracks, or otherwise exploit it. This includes the right to sublicense these rights to others for any purpose, including commercial purposes. MeriSkill reserves the right to remove any User Content at its discretion and without prior notice.
When providing User Content, you represent and warrant that:
– You have all necessary rights, licenses, and clearances to provide the User Content and to grant MeriSkill the rights described above.
– Your User Content is accurate, reasonably complete, and does not infringe or misappropriate any third-party rights.
– You are responsible for any third-party fees related to the provision and use of your User Content.
– Your User Content does not violate any laws or third-party rights, or constitute fraudulent statements, misrepresentations, or unfair business practices.
MeriSkill does not control the User Content posted on the Platform and does not guarantee its accuracy, integrity, or quality. MeriSkill is not liable for any User Content, including errors, omissions, or damages resulting from its use. You are responsible for ensuring that your User Content complies with applicable laws.
Prohibited Content on the Platform includes:
– Fraudulent, indecent, libellous, harassing, discriminatory, harmful, or threatening Content.
– Content discussing illegal activities with the intent to commit them.
– Content infringing on patents, trademarks, trade secrets, publicity rights, or other intellectual property rights.
– Content that you are not authorized to disclose.
– Profane, pornographic, obscene, indecent, or unlawful Content.
– Advertising or commercial solicitation.
– Content related to partisan political activities.
– Intentionally inaccurate or misleading Content.
– Viruses, malware, or other harmful components.
– Content that violates the rights of other users or advocates illegal activities.

Platform Security
To maintain the security and integrity of the Platform and associated platforms of MeriSkill, you are prohibited from engaging in or attempting any of the following activities:
– Accessing data not intended for you or logging into a server or account without authorization.
– Attempting to probe, scan, or test the vulnerability of systems or networks, or to breach security measures without proper authorization.
– Interfering with service to any user, host, or network, including through methods like virus submission, overloading, “flooding,” “spamming,” “mail bombing,” or “crashing.”
– Sending unsolicited emails, including promotional or advertising content.
– Forgery of any TCP/IP packet header or any part of email or newsgroup postings.
Violating system or network security may lead to civil or criminal liability. MeriSkill will investigate such violations and cooperate with law enforcement in prosecuting offenders. You agree not to use any device, software, or routine to interfere with the proper functioning of the Platform or any activities conducted on it. Additionally, you agree not to use automated tools or mechanisms, such as browsers, spiders, robots, or intelligent agents, except those provided by MeriSkill or generally available third-party web browsers (e.g., Google Chrome or Microsoft Edge), to navigate or search the Platform.
Disclaimer
The Platform and Tracks may contain typographical errors, inaccuracies, or incomplete information. MeriSkill reserves the right to correct any errors, inaccuracies, or omissions, and to update information at any time without prior notice.
The Platform, Tracks, and any MeriSkill Content are provided “as is” and “as available” with all faults. MeriSkill makes no representations or warranties of any kind, whether express or implied, regarding the MeriSkill Content or services available on or through the Platform and Tracks. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
MeriSkill does not warrant that the services will meet your requirements, be uninterrupted, timely, secure, or error-free. Nor does MeriSkill warrant the accuracy or reliability of any information obtained through the services, or that any defects in the software will be corrected.
You understand and agree that the use of MeriSkill Content and any material obtained through the Platform or Tracks is at your own discretion and risk. You are solely responsible for any damage to your computer system, electronic device, or loss of data that results from downloading such material or data.
No advice or information obtained from MeriSkill, whether oral or written, shall create any warranty not expressly stated in these Terms.
If you find incorrect information on the Platform or Tracks, or if you are the rightful owner of content and wish it to be removed, please contact us using the details provided at the bottom of the page.
Limitation of Liability
MeriSkill, its Educational Partners, affiliates, employees, directors, officers, agents, vendors, or suppliers shall not be liable to you or any other person, whether in Tort, Contract, Strict Liability, or otherwise, for any indirect, special, incidental, or consequential losses or damages arising out of or in connection with the use or inability to use the Platform or Tracks. Such damages may include lost profits, loss of goodwill, loss of data, work stoppage, accuracy of search results, or computer/electronic device failure, virus, or malfunction.
In no event shall MeriSkill’s liability exceed ₹1000 or, in the case of enrolled students, the fees paid by you in connection with your enrolment into a Track.
Site Linking
The Platform may include links to other websites (“Linked Sites”) that may offer products, services, or additional content. MeriSkill does not create, edit, or monitor these Linked Sites and therefore:
(a) We are not responsible for the accuracy or availability of information provided on Linked Sites;
(b) We do not control or endorse sponsors of Linked Sites, nor the content, products, advertising, or other materials presented on these sites;
(c) Your use of Linked Sites is subject to their respective terms and conditions, which you agree to.
We reserve the right to remove any Linked Sites from the Platform at any time, with or without explanation. MeriSkill is not liable for any transactions you conduct with third parties through Linked Sites or for any liability arising from the information or representations provided on those sites.
We respect the intellectual property rights of operators of Linked Sites. Links provided are for informational purposes only and do not imply any relationship or partnership with the operators of those sites.
You may not establish a link to this Platform from any other website, application, intranet, or extranet site without our prior written consent. If you wish to create links, please contact us beforehand. When establishing links, you must not falsely imply endorsement, sponsorship, or support from MeriSkill, including its Educational Partners, employees, agents, directors, officers, or shareholders.
Indemnity
You agree to protect and indemnify MeriSkill and its Educational Partners from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising from or related to (a) your use of the Platforms or Tracks in violation of these Terms; (b) your violation of any law or the rights of any third party; or (c) any information or Content that you or others post on the Platform or through any Track, including claims of intellectual property infringement or other proprietary rights violations.
Termination of Rights
MeriSkill reserves the right, at its sole discretion, to deactivate your account or terminate your access to the Platform or enrolment in a Track with or without cause. This includes situations where MeriSkill believes that you have (a) violated the Terms; (b) infringed upon the intellectual property rights of others; (c) posted unauthorized Content on the Platform; or (d) acted in a manner inconsistent with these Terms or any applicable code of conduct.
You acknowledge that MeriSkill may deactivate or terminate your access without prior notice, and MeriSkill will not be liable to you or any third party for any such action. Furthermore, even after termination, MeriSkill may retain and store your information on its systems.
Miscellaneous Provisions
By using the Platform, you confirm that you are at least 18 years old. If you are under 18 or under the legal age in your jurisdiction to enter into a contract, you may only use the Platform under the supervision of a parent or legal guardian who agrees to these Terms. If you are a parent or guardian agreeing to these Terms for a minor, you are fully responsible for their use of the Platform, including any financial charges or legal liabilities they may incur. By using the Platform, you affirm that you have the authority to agree to these Terms.
MeriSkill reserves the right to freely transfer or assign its rights or delegate its obligations under these Terms or any Track-specific terms. You may not transfer or assign your rights or delegate your obligations under these Terms or any Track-specific terms without MeriSkill’s prior written consent.
These Terms and any Track-specific terms are governed by the laws of India, without regard to its conflict of laws principles. Any legal action or proceeding relating to these Terms or Track-specific terms shall be brought exclusively in the courts of Jaipur. In the event of a dispute, the parties will first attempt to resolve it through good faith negotiations. If resolution is not achieved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1956, with arbitration proceedings conducted in English in Jaipur.
If any provision of these Terms or Track-specific terms is found unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability. MeriSkill shall not be liable for any failure to perform its obligations under these Terms due to events beyond its reasonable control, including natural disasters, war, terrorism, or governmental actions.
MeriSkill’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. These Terms constitute the entire agreement between you and MeriSkill regarding the subject matter herein, and may only be modified in writing by MeriSkill.
